About the Firm

Helping you and your family find the strength to rebuild — through turbulent times.

S.C. Chueh Attorneys-at-Law is a Taipei-based law firm focused on family law, children’s rights, and related civil, criminal and juvenile matters. We accompany clients and their families with both professional rigor and empathy, looking for the most suitable solution between negotiation and litigation.

Litigation draws clear lines between people through a court judgment, but it can also break relationships apart. In our experience, a considerable number of family cases can be resolved early through negotiation or mediation. When the issues are worked through in dialogue, parents and partners can keep cooperating after they leave the courtroom — and children can grow up in the place they belong.

Where a case involves coercive control (such as domestic violence or abusive partners) or an abuse of power (such as sexual assault or harassment in a position of authority), a court ruling is often necessary. In those cases we focus on empowering the individual through the process, so that they can return to daily life with renewed strength, and children are not left to grow up in a cycle of harm.

Many modern firms are oriented toward commercial interests. Our aspiration is to build a practice that can be a point of light for children and families in uncertain times.

Our Attorney

Attorney Shawn Chueh

Shawn Chueh 闕士超

Attorney-at-Law, Taiwan

Shawn is a family lawyer — and the father of a young boy. Born and raised in Taipei, he decided to study law after attending a law camp at National Taiwan University in high school.

His master’s thesis at National Yang Ming Chiao Tung University examined the role and procedure of forensic interviewers for child victims of sexual offences in criminal proceedings, which led him to devote his practice to children’s rights. He then joined the team of Attorney Fang-Yu Lai, where he handled more than a hundred divorce, custody, property-division and protection-order cases, including several high-profile divorces.

In his fourth year of practice he established his own practice. Besides family, child and gender-related matters, he works with central and local governments: he has served on selection panels for Ministry of Health and Welfare projects on sexual-violence prevention training and on a court-preparation handbook for child victims of sexual violence, and has investigated more than a hundred cases of improper discipline in kindergartens following the amendment of Taiwan’s Act Governing Preschool Educators and Caregivers.

In his sixth year of practice he studied common law at the Peter A. Allard School of Law, University of British Columbia, in Vancouver, Canada, and earned a master’s degree in common law. He has since returned to practice in Taipei. Whatever the size of a case, he believes every family deserves to be treated with care, and every child deserves to be protected.

Practice Areas

We advise and represent clients in family, civil, criminal, enforcement and juvenile matters, and serve as outside legal counsel to companies.

Family Law

Our core practice, with more than 300 family cases handled. We use negotiation, mediation, litigation and referrals to counselling or family consultation as needed, and begin each consultation by mapping the family’s relationships so that the legal strategy reflects the real needs of everyone involved.

Matters include divorce, child custody (the exercise of rights and assumption of duties in regard to minor children), protection orders, maintenance, meeting and communication with minor children (parenting time), provisional orders, distribution of the remainder of marital property, court-ordered separation of property regime, living expenses of the household, confirmation of parent-child relationships, guardianship over minors, orders of commencement of guardianship and assistance for adults, adult guardianship by agreement, prenuptial agreements and wills.

Negotiation

Out-of-court negotiation to reduce conflict, where we judge it suitable.

Mediation

Most divorce, custody, meeting-and-communication, maintenance, property and inheritance matters must first go through court mediation under Taiwan’s Family Act. We value an amicable parting, especially where co-parenting is at stake, and can ask the court for referrals to counselling or family consultation.

Litigation

If mediation does not succeed, we represent you throughout the court process, protecting your rights and the best interests of the children.

Cross-border family matters

See International Clients below.

Civil Litigation

With particular strength in disputes between family members, such as infringement of spousal rights, real-estate disputes within families and disputes over wills.

  • Infringement of spousal rights
  • Traffic accident claims
  • Sale and lease disputes
  • Real-estate disputes
  • Repair and leakage disputes

Criminal Matters

We help victims pursue justice and defend the accused, and have obtained acquittals on multiple occasions.

  • Bodily injury
  • Sexual offences
  • Child sexual exploitation
  • Fraud and money laundering
  • Theft
  • Defamation and offences against personal liberty

Enforcement

When a final judgment, mediation settlement or notarised agreement is not honoured, the other party may apply to the court for compulsory enforcement. We handle civil enforcement (provisional seizure, provisional injunction, or provisional enforcement) and family enforcement, including orders on meeting and communication with minor children, provisional orders and recognition of foreign judgments.

Juvenile Cases

Juvenile proceedings aim to support a young person’s healthy development and adjust their environment rather than simply assign criminal liability. Drawing on our family-law experience, we take a whole-family view to secure appropriate measures for the young person, and also assist victims.

Corporate Legal Counsel

We serve as retained legal counsel to a number of companies, assisting with contract review and legal risk assessment.

For International Clients

Attorney Chueh works with clients in English and has assisted many foreign nationals with cross-border marriage, custody and property issues. We have represented clients connected to mainland China, the United States, Canada, Japan, Germany, Singapore and Dubai, among others.

We also have extensive experience applying to Taiwanese courts for recognition and enforcement of foreign judgments.

Consultations can be conducted in English or Mandarin Chinese. Whether or not you go on to engage our firm, everything you share with us is kept confidential as required by law.
